Terms and Conditions
Effective Date: August 5, 2026
Last Updated: August 5, 2026
These Terms and Conditions (the “Terms”) govern your access to and use of https://dsc-webservices.com/ and its pages, content, features, and functionality (collectively, the “Website”). The Website is owned and operated by DSC Web Services Incorporated (“DSC Web Services,” “we,” “us,” or “our”).
Please read these Terms carefully. By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Website.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Website. By accessing or using the Website, you represent and warrant that you meet these requirements.
2. Scope of These Terms
These Terms govern use of the public Website only. They do not govern website design, development, hosting, maintenance, search engine optimization, advertising, marketing, lead generation, consulting, or other professional services provided by DSC Web Services.
Any services we provide to a client will be governed by a separate written proposal, statement of work, service agreement, order form, or other contract (a “Service Agreement”). If a Service Agreement conflicts with these Terms concerning paid services, the Service Agreement will control.
3. Website Information, Quotes, and Service Descriptions
The Website provides general information about DSC Web Services and topics related to websites, search engine optimization, marketing, lead generation, and related subjects. Website content is provided for general informational and promotional purposes. It is not professional legal, tax, accounting, or financial advice and should not be treated as a substitute for advice tailored to your circumstances.
Service descriptions, availability, examples, pricing references, timelines, estimates, and other information displayed on the Website may change and do not constitute a binding offer or guarantee. A request for information or a quote does not require either you or DSC Web Services to enter into a business relationship. Pricing, deliverables, schedules, payment terms, and other service obligations become binding only when stated in a Service Agreement accepted by the applicable parties.
We try to keep Website information accurate and current, but we do not warrant that all content is complete, accurate, current, or free from errors.
4. Marketing Results, Testimonials, Reviews, and Case Studies
Marketing and website performance depend on many factors outside our control, including market conditions, competition, search engine and platform changes, advertising budgets, a client’s products, services, pricing, reputation, responsiveness, business practices, and implementation of recommendations.
DSC Web Services does not guarantee search engine rankings, website traffic, leads, conversions, sales, revenue, return on investment, customer acquisition, or any other marketing or business result.
Testimonials, reviews, case studies, examples, statistics, portfolio items, and descriptions of past client results reflect particular experiences under particular circumstances. They are provided for illustrative purposes only. Past results are not typical, are not promises or guarantees of future performance, and should not be understood as the results that every client or Website visitor will achieve. Your results may differ materially, including the possibility that you may achieve no improvement or may experience a loss.
Nothing on the Website creates a guarantee or warranty concerning the outcome of any service. Any express commitments applicable to a client engagement must appear in the governing Service Agreement.
5. Ownership and Intellectual Property
The Website and its content—including text, articles, graphics, photographs, videos, layouts, designs, logos, icons, code, downloads, and other materials—are owned by DSC Web Services or used with permission from clients, licensors, or other rights holders. They are protected by United States and international intellectual property and other laws.
Subject to these Terms, we grant you a limited, nonexclusive, nontransferable, nonsublicensable, and revocable license to access and use publicly available Website content for your personal use or internal business reference. This license does not transfer any ownership rights.
Unless we give prior written permission, you may not:
- reproduce, republish, sell, license, distribute, publicly display, or commercially exploit Website content;
- remove or alter copyright, trademark, attribution, or proprietary notices;
- use Website content to create a competing product, service, publication, database, or content library;
- use automated tools to scrape, harvest, copy, index, extract, or download Website content except for ordinary indexing by generally available search engines; or
- use our names, logos, trademarks, service marks, or branding in a way that suggests sponsorship, endorsement, affiliation, or permission.
Any rights not expressly granted in these Terms are reserved.
6. User Submissions
The Website may now or in the future allow you to submit inquiries, messages, comments, reviews, feedback, files, images, or other content (collectively, “User Submissions”). You retain ownership of any intellectual property rights you have in your User Submissions.
You represent and warrant that:
- you own or have all rights and permissions necessary to submit the User Submission;
- the User Submission is accurate to the best of your knowledge and is not misleading;
- the User Submission does not infringe or violate another person’s intellectual property, privacy, publicity, contractual, or other rights; and
- the User Submission complies with these Terms and applicable law.
When you submit content intended for public display, you grant DSC Web Services a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify for formatting or technical purposes, publish, display, distribute, and otherwise use that content in connection with operating, improving, and promoting the Website and our business. This license does not authorize us to use personal information in a manner inconsistent with our Privacy Policy.
Contact-form messages, quote requests, and other nonpublic communications will not be publicly posted merely because you submit them. They will be handled as described in our Privacy Policy. However, sending information through a general Website form does not create an attorney-client, fiduciary, confidential, or other special relationship. Do not submit trade secrets or highly sensitive or confidential information unless we have separately agreed in writing to receive it.
We are not required to publish, retain, monitor, or review User Submissions. We may remove, restrict, or decline to publish a User Submission at any time and for any lawful reason.
If you voluntarily send suggestions, ideas, or other feedback about our Website or services, we may use that feedback without restriction or compensation to you, provided that our use of associated personal information remains subject to our Privacy Policy.
7. Prohibited Conduct
You may not use the Website to:
- violate any applicable law, regulation, court order, or the rights of another person;
- submit false, fraudulent, defamatory, obscene, threatening, harassing, discriminatory, or unlawful material;
- impersonate another person or misrepresent your identity, affiliation, or authority;
- introduce malware, malicious code, corrupted data, or other harmful technology;
- interfere with, damage, disrupt, overload, probe, scan, or test the vulnerability or security of the Website or a connected network without authorization;
- gain or attempt to gain unauthorized access to the Website, accounts, systems, servers, or data;
- collect personal information about others without authorization;
- send spam, unauthorized advertising, chain letters, or other unsolicited communications through the Website;
- use bots, scripts, crawlers, or automated means to access or interact with the Website in a manner that exceeds ordinary search-engine indexing or our written permission;
- reverse engineer, decompile, or attempt to discover source code except where a restriction is prohibited by law; or
- help or encourage another person to engage in prohibited conduct.
We may suspend, restrict, or terminate access to the Website if we reasonably believe a user has violated these Terms, created risk or legal exposure, or interfered with the Website or other users.
8. Third-Party Websites, Tools, and Content
The Website may link to, display, or integrate websites, maps, scheduling services, social media platforms, videos, software, content, or other products and services provided by third parties. Third-party services are provided for convenience and are governed by their own terms and privacy policies.
We do not control and are not responsible for third-party websites, services, availability, security, accuracy, content, products, or practices. A link, integration, or reference does not necessarily mean that DSC Web Services endorses or guarantees the third party. You access and use third-party services at your own risk.
9. Privacy
Our collection and use of personal information through the Website are described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. If you submit personal information through the Website, you represent that the information is accurate and that you have the right to provide it.
10. Website Availability and Changes
We may add, remove, modify, suspend, restrict, or discontinue any part of the Website at any time without notice. We do not guarantee that the Website or any feature will always be available, uninterrupted, secure, or error-free. We are not responsible for delays, interruptions, data loss, or other problems inherent in Internet and electronic communications.
We may correct errors or omissions and update Website content at any time.
11. Copyright and Intellectual Property Complaints
If you believe material on the Website infringes your copyright or other intellectual property rights, send a written notice to support@dsc-webservices.com containing:
- your name and contact information;
- identification of the protected work or right you believe has been infringed;
- identification and location of the material you believe is infringing;
- a statement explaining why you believe the use is unauthorized;
- a statement that the information in your notice is accurate and that you are the rights owner or authorized to act for the rights owner; and
- your physical or electronic signature.
We may remove or restrict access to challenged material while reviewing a complaint. Submitting a knowingly false infringement notice may result in legal liability.
12. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. DSC WEB SERVICES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS, PRODUCE ANY PARTICULAR RESULT, OPERATE WITHOUT INTERRUPTION OR ERROR, OR BE FREE OF HARMFUL COMPONENTS. YOU ARE RESPONSIBLE FOR EVALUATING WEBSITE INFORMATION AND FOR YOUR DECISIONS BASED ON IT.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DSC WEB SERVICES AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, USE, OR DATA; OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF DSC WEB SERVICES AND THE OTHER PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot lawfully be excluded or limited. They apply only to use of the public Website and do not replace any liability terms contained in an applicable Service Agreement.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless DSC Web Services and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your unlawful or unauthorized use of the Website;
- your User Submissions;
- your violation of these Terms; or
- your violation of another person’s rights.
We reserve the right to control the defense and settlement of a matter subject to indemnification, and you agree to reasonably cooperate with that defense. You may not settle a claim in a manner that imposes liability or an obligation on us without our prior written consent.
15. Governing Law and Venue
These Terms and any dispute arising out of or related to the Website will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Subject to any applicable law that requires otherwise, you and DSC Web Services agree that any legal action arising out of or related to the Website or these Terms must be brought exclusively in the state courts located in Brazos County, Texas, or the United States District Court with jurisdiction over Brazos County, Texas. You and DSC Web Services consent to the personal jurisdiction and venue of those courts.
16. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated “Last Updated” date. Changes become effective when posted unless a later date is stated. Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
17. General Provisions
These Terms, together with the Privacy Policy and any additional terms expressly presented for a Website feature, constitute the entire agreement between you and DSC Web Services concerning use of the public Website.
If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
Headings are provided for convenience only and do not affect interpretation. Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and disputes.
